Employer Nomination Scheme

The ENS scheme is designed to allow Australian employers to sponsor eligible employees, who are not Australian citizens or Permanent residents, for a permanent visa to live and work in Australia.

This visa will allow unlimited entry and departure from Australia for a period of five years. If the holder wishes to return to Australia beyond that period of time and they have not taken care of the citizenship process, they will need to obtain a Resident Return Visa.

This visa has a two stage process and has common criteria that applies to both streams such as meeting health/character criteria and public interest criteria.

  • The company nominates the position and the person to fill the position
  • The prospective employee applies for the visa

There are three streams to this visa – the two most common are the Temporary Resident Transition Stream and the Direct Entry stream.

Temporary Resident Transition Stream

  • Age under 45
  • Must have a prescribed level of English language ability – exemptions may apply
  • The nomination must be approved and current
  • Must hold a sc457/sc482 visa that was nominated by the same employer and in the same occupation unit group code
  • Must have been employed by the original employer on that sc457/sc482 visa for a total period of at least 3 years during the previous 4 years before the nomination is made, unless transitional arrangements apply.
  • Must be employed for a period of two years minimum from date of visa grant
  • Terms and conditions of the employment must equal that provided to an Australian citizen or Permanent Resident
  • No adverse information known to Immigration

Direct Entry Nomination

  • Age under 45
  • Must have a prescribed level of English language ability – exemptions may apply
  • The nomination must be approved and current
  • Must have a skills assessment and three years experience in the occupation
  • Terms and conditions of employment must equal that provided to an Australian citizen or Permanent Resident
  • No adverse information known to immigration

COMPANY NOMINATION REQUIREMENTS

  • The nominating business must identify the need for a paid employee
  • Must be actively and lawfully operating a business in Australia
  • Must offer a two year contract
  • Employer must pay the SAF Levy based on company turnover
  • Must offer equal terms and conditions to that of an Australian citizen or Permanent Resident
  • Has complied with laws related to workplace relations and has no adverse information known to immigration
  • Must be nominating an occupation on the current MLTSSL/STSOL
